Terms of Service.
The agreement for your Level2 account, our websites, the Level2 Client and support.
These terms are an agreement between you and Version2 j.d.o.o. za digitalni marketing, Novigradska ulica 21, 23000 Zadar, Croatia ("Level2Studio", "we", "us"). Level2Studio is a brand of Version2 and the studio behind OUTREMER. Our full company details are on the Version2 legal notice.
Please read them. They are written to be understood without a lawyer. If anything is unclear, ask us at support@level2.studio before you agree.
1. What these terms cover
These terms apply to:
- your Level2 account, wherever you create it or sign in to it (level2.studio, playoutremer.com, the Level2 Client or a game);
- the Level2 Client, our app for installing, updating and opening our games;
- our websites level2.studio and playoutremer.com;
- support, including tickets, and the community spaces we run (together, the "Services").
Our games and the Level2 Client are also covered by the End User Licence Agreement, which sets out what you may do with the software itself. How we handle personal data is explained in our privacy notices, for this website and for the Level2 account and our games. They are not part of this contract and apply without your agreement.
If you play through a store such as Steam or the Epic Games Store, that store's own terms also apply to your use of the store and to anything you buy there.
Nothing in these terms takes away rights you have under the consumer law of the country where you live.
2. Your Level2 account
Who can have an account. You must be at least 16 years old, or have the consent of a parent or guardian if you are younger and the law where you live allows it. A parent or guardian who consents is responsible for the younger player's use of the Services.
One person, one account. Your account is for you alone. Do not share it, sell it, buy someone else's, or let others play on it. Do not create accounts to get around a suspension.
Accurate details. Give a real email address that you control, and keep it up to date. We use it to sign you in, recover your account and tell you about important changes.
Keep it safe. Keep your password and recovery codes to yourself. We will never ask you for them. If you think someone else has used your account, tell us at once through a support ticket.
Signing in with another service. If you sign in with Steam, Epic Games or Google, that service confirms who you are under its own terms. You can ask us to unlink it, as long as your account keeps another way to sign in.
Your player name. The name and tag other players see must follow the rules in section 4. We may reset a name that breaks them.
3. Free play, purchases and virtual items
Free to play. OUTREMER is planned as free to play. Paying is never required to play the game.
Virtual items. You may be able to get cosmetic items, founder rewards or other in-game items ("virtual items"), either free or by buying them. A virtual item gives you a personal licence to use it in our games while the game runs. It is not property you own, it has no cash value, and it cannot be exchanged for money or moved to another account unless we offer a way to do so.
Who sells to you. The seller of a purchase is named at checkout. When a store or our payment partner sells to you, its terms govern payment, tax, receipts and refunds; these terms govern the items you receive and your account.
Your right to withdraw. In the EU, you can usually withdraw from an online purchase within 14 days. For digital content that is delivered to you straight away, that right ends when delivery starts, but only if you agreed at checkout to immediate delivery and confirmed that you understood you would lose the right to withdraw. Where you did not, you keep the full 14 days.
If something you bought does not work. You have the legal guarantee for digital content: what you bought must be supplied, and it must work as described and as you can reasonably expect. If it does not, we will fix it; if we cannot within a reasonable time, you may ask for a price reduction or end the purchase and get your money back. These rights are yours by law and do not depend on a seller's refund policy.
4. Rules of conduct
Play fair and treat people decently. While using the Services, you must not:
- cheat: use or make cheats, aimbots, wallhacks, macros that play for you, bots, or any software that gives an unfair advantage or changes how the game works;
- exploit bugs on purpose, or keep using one once you know it gives an unfair advantage; report it instead;
- manipulate matches, such as boosting, win trading, losing on purpose or playing on another player's account;
- harass, threaten, bully, stalk or dox anyone, or encourage others to do so;
- post or say anything hateful against people for who they are, sexual content involving minors, content that glorifies real violence or terrorism, or anything else that is illegal;
- impersonate staff, other players or anyone else;
- sell, buy or trade accounts, virtual items or in-game services for real money or anything of value, outside a feature we provide;
- spam, advertise, scam, phish, or ask others for their passwords or payment details;
- access or try to access accounts, data or systems that are not yours, overload or disrupt the Services, or test their security without our permission (security reports are welcome; see section 11);
- collect other players' data, or use automated tools to access the Services, unless we allow it in writing;
- break the law, or help anyone else break these rules.
Rules for specific spaces, such as our Discord server, also apply there. Discord is a separate service with its own terms.
5. What you share, and how to report a problem
Your content stays yours. Some features let you share things: your player name, messages, reports, tickets, feedback and, where available, chat. You keep the rights you have in what you share. You give us a worldwide, free licence to store, show, copy and transmit it as far as we need to run, improve and protect the Services and, for feedback and ideas, to use them to improve our games without owing you anything. The licence for content other players can see ends when you delete it or your account, except for copies we must keep by law or to handle a report.
You are responsible for what you share. Do not share anything you do not have the right to share.
Reporting illegal content or rule breaks. Anyone, with or without an account, can tell us about content they believe is illegal or breaks these terms. Submit a support ticket or email support@level2.studio. Tell us:
- where the content is, precisely enough for us to find it (the player name and tag, the match, a link or a screenshot);
- why you think it is illegal or breaks our rules;
- your name and email address, unless the report concerns the sexual abuse of children; and
- that you believe in good faith that your report is accurate and complete.
We confirm that we received your report, look at it carefully and without bias, and tell you what we decided and how you can challenge it. Reports are reviewed by people.
6. When we take action
If you break these terms or the law, we may, depending on how serious and how repeated it is:
- warn you;
- remove or hide content, or reset your player name;
- limit features such as chat, matchmaking or trading;
- suspend your account for a period; or
- close your account permanently.
We act in a diligent, objective and proportionate way and consider everyone's rights and interests, including freedom of expression. For serious harm, such as cheating, threats or illegal content, we may act without a warning first.
We tell you why. When we restrict your account or your content, we tell you what we did, what it is based on (the rule or the law), the facts we relied on, whether automated means were used, and how you can challenge it, unless the law prevents us from telling you or the content is deceptive high-volume spam. Some cheating is detected and acted on automatically, which can include an automatic suspension or ban.
You can challenge a decision. Reply to our decision, or submit a support ticket, within six months. This includes automatic decisions. A person who did not make the original decision reviews it, and we reverse it if it was wrong. You can also go to court or use any other remedy the law gives you.
7. Keeping the Services running, and changing them
Online services. Our games and the Level2 Client need an internet connection and our servers. We work to keep them available, but there will be maintenance, updates and occasional outages.
Playtests and early access. Test builds and early access versions are unfinished. They can be unstable, reset progress or change a lot between versions. We tell you before you join when progress or items will not carry over.
Changes to the games. Games that run over time change: we fix bugs, balance weapons and maps, add and remove content, and adapt to new devices, stores and laws. We make these changes when there is a valid reason of this kind, at no extra cost to you, and we tell you about them clearly, for example in patch notes. If a change will make your access to, or use of, something you paid for clearly worse in a way that is more than minor, we tell you in advance by email or in the Level2 Client, and you may end the contract for that purchase free of charge within 30 days after the change and get a refund for the part you have not used.
Ending a game. If we decide to stop running a game or a paid feature, we tell you at least 90 days before. Paid items that can no longer be used are handled as the law requires, which can include a partial refund.
8. Ending this agreement
You can leave at any time. Ask us to close your account through a support ticket, or close it in your account settings where that option is available. Closing it ends this agreement. What happens to your data is explained in the privacy notice.
When we can end it. We may suspend or close your account under section 6, if the law requires it, or if your account has not been used for three years and we warned you by email at least 60 days before. In any other case we give you at least 30 days' notice and a reason.
What happens afterwards. Your licence to use virtual items ends with your account. If we close your account for a reason other than your breach of these terms, we refund what you paid for anything you can no longer use, to the extent the law requires, and on request we give you a copy of content you shared that is not personal data, in a commonly used format.
9. Our responsibility to you
We are fully liable under the law for harm we cause intentionally or through gross negligence, for death or personal injury, and for anything else the law does not allow us to limit. You keep your legal guarantee for digital content (section 3).
Otherwise, for slight negligence we are liable only if we breach an obligation that is essential to this agreement, and only for damage that was typical and foreseeable when you agreed to these terms.
We are not responsible for problems caused by things outside our reasonable control, such as a failure of your device or internet connection, a store or sign-in service being unavailable, or another player breaking these terms, where we were not at fault.
10. Changes to these terms
We may update these terms when the Services, the law or the way we run them changes. For an important change, we tell you by email or in the Level2 Client at least 30 days before it takes effect, explain what changes and why, and show the new text. If you do not agree, you can close your account before the change takes effect; we refund what you paid for anything you can no longer use, to the extent the law requires. Continuing to use the Services after that date means you accept the new terms. Changes that only correct mistakes or describe a new optional feature take effect when we publish them.
11. Contacting us
- Support, reports and appeals: a support ticket, or support@level2.studio.
- Our single point of contact for players, and for authorities and the European Commission under the Digital Services Act: support@level2.studio. We answer in English and Croatian.
- Security problems: support@level2.studio with Security in the subject.
- Privacy requests: privacy@playoutremer.com.
- Letters: Version2 j.d.o.o., Novigradska ulica 21, 23000 Zadar, Croatia.
We send you notices by email or in the Level2 Client. Keep your email address current.
12. The law, and settling disputes
These terms are governed by Croatian law. If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of the country where you live.
Please contact us first; most problems are solved quickly that way. If we cannot agree, you can take the matter to the courts where you live or to the courts in Zadar, Croatia. We can bring a claim against a consumer only in the courts of the country where that consumer lives.
13. Stores and platforms
If you got a game through a store, these terms are between you and us only. The store is not responsible for our Services and is not a party to these terms, and its own terms govern your account with the store and what you buy there. Where a store's terms say they take priority over ours on a point, they do.
14. Other things you should know
- If a court finds part of these terms invalid, the rest stays in force.
- If we do not enforce a term straight away, we can still enforce it later.
- We may transfer this agreement to a company that takes over the Services. We tell you first, and your rights do not get worse because of it. You may not transfer your account or this agreement.
- These terms, together with the End User Licence Agreement and any rules shown for a specific feature or event, are the whole agreement between you and us about the Services.
- These terms are written in English. If we publish them in another language, neither version reduces your rights under the law.
