Licence agreement.
What you may do with OUTREMER and the Level2 Client.
This End User Licence Agreement ("EULA") is between you and Version2 j.d.o.o. za digitalni marketing, Novigradska ulica 21, 23000 Zadar, Croatia ("Level2Studio", "we", "us"). Level2Studio is a brand of Version2. Our full company details are on the Version2 legal notice. This EULA covers:
- OUTREMER, including its updates, downloadable content and virtual items (the "Game"); and
- the Level2 Client, our app for installing, updating and opening our games (the "Client").
Together, the Game and the Client are the "Software". Your Level2 account and our online services are covered by the Level2 Terms of Service, which apply alongside this EULA.
If you got the Game from a store. On Steam, this EULA is the "Subscription Terms" for OUTREMER under the Steam Subscriber Agreement. On the Epic Games Store, it is the "Software Specific Terms" under the Epic Games Store End User License Agreement. In both cases the store's agreement continues to govern the store, your purchase and its refund, and where that agreement says it takes priority over ours, it does. The store is not a party to this EULA.
Nothing in this EULA takes away rights you have under the consumer law of the country where you live.
1. Your licence
We give you a personal, non-exclusive, non-transferable licence to install and use the Software on devices you own or control, for your own non-commercial entertainment, for as long as this EULA is in force.
The Software is licensed, not sold. We and our licensors keep all rights in it, including the copyright in its code, art, sound, music, characters, world and story, and the names OUTREMER, Level2Studio and Level2 and their logos. Everything this EULA does not expressly allow is reserved.
2. What you may not do
Except where the law allows it and this EULA cannot forbid it, you may not:
- copy, sell, rent, lend, sublicense or otherwise distribute the Software, or make it available over a network for others to use;
- modify, translate, decompile, disassemble or reverse engineer the Software, or create derivative works from it, except as described in section 3;
- create, use or share cheats, bots, hacks, mods that change gameplay, or any software that reads or alters the Game's memory or network traffic;
- remove, disable or get around copy protection, cheat detection, licence checks or other technical measures in the Software;
- run, connect to or offer servers or services for the Game that we have not authorised, or emulate our services;
- extract the Game's assets, data or code for use elsewhere, including to train machine-learning models;
- use the Software for any commercial purpose not allowed in section 6; or
- remove copyright, trademark or other notices from the Software.
3. Rights the law gives you anyway
Some rights cannot be taken away by a licence, and this EULA does not try to. In particular, under EU law you may make a back-up copy where that is necessary for your use, observe and test how the Software works while using it normally, and decompile parts of it where that is indispensable to make another independent program work with it, within the strict limits of Articles 5 and 6 of Directive 2009/24/EC as applied by Croatian law.
4. Online features, accounts and fair play
The Game is played online. Using it needs a Level2 account, an internet connection and our servers, and is subject to the rules of conduct in the Terms of Service.
To keep matches fair, the Game and our servers check for cheating. Some cheating is detected and acted on automatically, which can include an automatic suspension or ban; you can appeal any such decision, and a person reviews it (section 6 of the Terms of Service). Before we add software that checks for cheating on your device, we will describe it in this EULA and in the privacy notice.
5. Updates
The Client keeps itself and our games up to date. Some updates are needed to keep playing online, and some are needed to keep the Software secure and working as described; we provide those for as long as the law requires, and you need to install them to keep the legal guarantee for problems they would have fixed. If you choose not to install an update, we are not responsible for a problem that exists only because of that.
Updates may change the Game, as described in section 7 of the Terms of Service.
6. Videos, streams and fan content
We want people to share the Game. You may record, stream and publish videos and screenshots of yourself playing the Game, and you may earn money from them through the normal programmes of the platform you publish on (such as advertising, subscriptions or donations), as long as:
- you do not sell the Game's assets, or put them behind a paywall of your own;
- you do not suggest that we made, sponsored or endorse your work unless we have agreed in writing;
- you respect the rules of conduct, and do not share content from tests or unreleased builds that we asked you to keep private; and
- you stop using our material if we ask you to because a specific use harms the Game or its players.
Fan art and other fan works follow the same rules. Using our names or logos as the brand of your own product, channel or event needs our written permission.
7. Playtests, early access and private builds
Some builds are shared before release, in playtests or early access. When we tell you a build or its content is confidential, you agree not to share it, its content or recordings of it until we say you may. Test builds may be incomplete, unstable or reset, and are provided for testing.
If you give us feedback, ideas or bug reports, we may use them to improve our games without owing you anything, and we are not obliged to use them.
8. Third-party components
The Software includes components made by others, used under their licences. Their notices are in the Software's credits and licence files. Where a component's licence gives you more rights than this EULA, that licence applies to that component.
9. Our responsibility to you
You have the legal guarantee for digital content: the Software must be supplied, work as described and as you can reasonably expect, and receive the updates described in section 5. If it does not, you have the remedies the law gives you, including having it fixed or, where it cannot be fixed, a price reduction or ending the contract. Our liability for damage is as set out in section 9 of the Terms of Service.
Beyond those rights, we do not promise that the Software will be free of every bug or available without interruption.
10. Ending this EULA
You can end this EULA at any time by uninstalling the Software and, if you wish, closing your Level2 account. It ends automatically if your account is closed. We may end it as set out in section 8 of the Terms of Service. When it ends, you must stop using the Software and delete it from your devices.
Sections 2, 3, 8, 9, 10 and 11 continue to apply after this EULA ends, where that makes sense.
11. The law, and other things you should know
This EULA is governed by Croatian law. If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of the country where you live. Disputes are handled as set out in section 12 of the Terms of Service.
If a court finds part of this EULA invalid, the rest stays in force. We may change this EULA in the same way and with the same notice as the Terms of Service (section 10 there).
This EULA is written in English. If we publish it in another language, neither version reduces your rights under the law.
